General Terms and Conditions (GTC) for the BLACKCAMP online shop

1. Scope of application

These General Terms and Conditions apply to all orders placed via the BLACKCAMP online shop and not to purchase contracts concluded outside the online shop (e.g. purchase of a BLACKCAMP mini-caravan). You can find the general terms and conditions for purchase contracts here.

2. Contractual partner, conclusion of contract

The contract is concluded with Schwarz GmbH, represented by Andreas Schwarz, Frangart, Eppan, South Tyrol, Italy. The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. By clicking on the ‘Buy now’ button, you place a binding order for the goods contained in the shopping basket. Confirmation of receipt of your order will be sent by e-mail immediately after the order has been sent and does not constitute acceptance of the contract. We can accept your order by sending an order confirmation by e-mail or by delivering the goods within five days.

3. Prices and terms of payment

The prices quoted are final prices including 22% VAT. In addition to the prices quoted, we charge shipping costs for delivery (see Shipping). Payment can be made in advance by bank transfer, credit card or other payment methods offered.

For orders placed by companies, VAT is not applicable. To order as a company, it is necessary to state the company name and/or VAT number. This is checked in the VIES register before the order is placed. Only after successful validation will the VAT be removed from the order total. If your company is not registered in the VIES register, please contact us to confirm the order manually.

4. Shipment

The goods will be dispatched within five working days of receipt of payment. Dispatch by the shipping company usually takes 3-6 working days. If an item is not available or cannot be delivered in time, we will inform you by email and offer a free refund. Depending on the product category and shipping country, the following shipping costs apply:

All products except awnings and roof tents:

  • Collection: Free of charge during regular opening hours at our headquarters in Eppan (Italy)

  • Standard shipping within Italy, Germany, France: 18€

  • Standard shipping to Switzerland: 48€

Awnings:

  • Collection: Free of charge during regular opening hours at our headquarters in Eppan (Italy)

  • Standard shipping within Italy, Germany, Austria, France: 80€

  • Standard shipping to Switzerland: 150€

Roof tents:

  • Collection: Free of charge during regular opening hours at our headquarters in Eppan (Italy)

  • Standard shipping within Italy, Germany, Austria, France: 130€

  • Standard shipping to Switzerland: 200€

All prices include 22% VAT.

5. Return of goods

In accordance with the EU guidelines for online trading, you have the right to cancel the purchase within 14 days of receipt of the goods without giving any reason.

Only unused and intact goods in the original box, which show no damage and are returned complete with all accessories and enclosures, can be refunded. Obviously used or faulty goods, as well as goods with missing accessories, are excluded from return. In such cases, a return can be made after prior authorisation and against a reduction of the refund amount (please clarify by e-mail). If the returned goods are faulty, damaged, used or incomplete without prior notification, we reserve the right not to make a refund or to reduce the refund amount. The buyer bears the costs of the return shipment.

Please contact us before returning the goods to coordinate the return.

6. Warranty

The statutory warranty provisions shall apply. The statutory warranty provisions shall apply. For end consumers, the warranty period is 24 months from delivery of the goods. There may be typesetting and printing errors or technical errors in the calculation.Please contact us to make a warranty claim.

7. Request for quotation for exhibits or online configured BLACKCAMP mini caravans

A request for quotation for exhibition items or BLACKCAMP mini caravans configured online does not constitute a binding purchase. We endeavour to show you correct prices, but do not guarantee that the prices suggested in the configurator are complete and error-free. There may be typesetting and printing errors or technical errors in the calculation. The data you provide will be used in accordance with our privacy policy. A possible sales contract will be concluded in writing. Payment is only possible by bank transfer within the period specified in the invoice. For alternative payment methods, please contact us individually.

8. Data protection

We collect, process and use your personal data only in compliance with the applicable data protection laws. You can find more information on data processing in our privacy policy.

9. Applicable law, place of jurisdiction

The law of the Italian Republic applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from this contract is Bolzano, South Tyrol.

10. Disclaimer

We are not liable for damage caused by improper handling or use of the products. Liability for slight negligence is excluded unless material contractual obligations (cardinal obligations) have been breached. In the event of a breach of material contractual obligations, liability shall be limited to the foreseeable damage typical of the contract.

11. Reservation of title

The goods shall remain our property until full payment has been made. Prior to the transfer of ownership, pledging, transfer by way of security, processing or remodelling is not permitted without our consent.

12. Online dispute resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr. We are prepared to participate in an out-of-court arbitration procedure before a consumer arbitration board.

13. Changes to the GTC

We reserve the right to amend these General Terms and Conditions at any time. You will be notified of the amended terms and conditions by email and will be deemed to have been accepted if you do not object in writing within 14 days.

14. Final provisions

Should a provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision.
